These terms describe the rules and responsibilities that apply when you access or use Famleys.

1. Your agreement

These Terms & Conditions (“Terms”) are a binding agreement between you and Famleys (“Famleys”, “we”, “us”, or “our”). They govern your access to the Famleys website, mobile applications, and related services (together, the “Service”).

By creating an account, accepting an invitation, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be legally able to enter into this agreement in your location. If you are below the applicable age of digital consent, you may use Famleys only through a managed profile created and supervised by a parent or legal guardian, or as otherwise permitted by law.

You agree to provide accurate information, keep your credentials confidential, and promptly tell us of suspected unauthorized use. You are responsible for activity under your account unless applicable law provides otherwise.

3. Family spaces and permissions

The Service lets users create or join shared family spaces. Administrators can invite or remove members, assign roles, create managed profiles, and configure family settings. Members may be able to view or change shared content depending on their role and the feature being used.

If you administer a family space, you are responsible for inviting only appropriate people, managing access, and obtaining any consent required to create managed profiles or enter information about another person. If you leave or are removed from a family space, you may lose access to its content.

4. Acceptable use

You may use the Service only lawfully and as intended. You must not:

  • violate another person’s privacy, intellectual property, or other rights;
  • upload unlawful, harmful, abusive, deceptive, or malicious content;
  • attempt to access accounts, data, systems, or features without authorization;
  • interfere with the Service, bypass security or usage limits, or introduce malware;
  • reverse engineer or copy the Service except where applicable law expressly permits it;
  • use automated means to scrape, extract, or overload the Service without our written permission; or
  • use the Service to provide a competing service or for unlawful surveillance.

5. Your content

You retain ownership of content you submit to the Service. You grant Famleys a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display that content only as needed to operate, secure, improve, and support the Service and to comply with law.

You confirm that you have the rights and permissions needed to submit the content and share it with the members you select. You are responsible for your content and should not add highly sensitive information unless a feature expressly calls for it.

We may remove or restrict content that violates these Terms, creates risk, or is unlawful, subject to applicable law.

6. Connected and third-party services

The Service may connect to calendars, authentication providers, app stores, notification services, or other third-party products. Those products are governed by their own terms and policies. We do not control and are not responsible for third-party services. You can usually remove a connection through Famleys or your device or provider settings.

7. Fees and paid features

Famleys may offer free and paid features. Before charging you, we will show the price, billing period, and applicable purchase terms. App-store purchases are also subject to the store’s rules. Unless required by law or stated otherwise at purchase, payments are non-refundable. We will provide notice of material price changes as required.

8. Service changes and availability

We may add, change, suspend, or discontinue features as the Service evolves. We aim to provide a reliable experience, but we do not guarantee uninterrupted or error-free access. The Service is not an emergency, medical, financial, childcare-monitoring, or safety-critical system. Keep independent copies of information you cannot afford to lose.

9. Famleys property

Famleys and its licensors own the Service, including its software, design, branding, and content we provide. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for personal and household purposes. No other rights are granted.

10. Suspension and termination

You may stop using the Service at any time and may request account deletion through available settings or by contacting us. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if necessary to protect the Service or others. Where appropriate and legally required, we will provide notice and an opportunity to appeal.

Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, will survive.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Famleys disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Famleys and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the Service.

Where liability cannot be excluded, Famleys’ total liability for claims relating to the Service will not exceed the greater of the amount you paid Famleys for the Service during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. These limits do not apply where prohibited or to liability that cannot lawfully be limited.

13. Applicable law and disputes

These Terms are governed by the laws that apply to your relationship with Famleys, without regard to conflict-of-law principles. Before starting formal proceedings, you and Famleys agree to try in good faith to resolve a dispute by written notice, unless urgent relief is needed or applicable law gives you another right. Nothing here limits consumer protections or access to courts that cannot lawfully be limited.

14. Changes to these Terms

We may update these Terms as the Service evolves or laws change. We will post the revised Terms with a new “Last updated” date and provide additional notice for material changes where required. If you continue using the Service after revised Terms take effect, you accept them. If you do not agree, you should stop using the Service.
